In 2009, a three-judge federal appeals court sitting in the 5th Circuit Court of Appeals held that the State of Louisiana had to place the names of both unmarried parents on their son's Louisiana birth certificate.
The State of Louisiana continues to argue that this would break Louisiana law because unmarried parents cannot adopt together. The adoption of their son was finalized in New York.
This case is back before the appellate division for a rehearing before 16 federal appellate court judges. The hearing is scheduled for today.
